11. APPROVAL OF THE READINESS AND EMERGENCY MANAGEMENT FOR SARASOTA COUNTY, FLORIDA SCHOOLS GRANT APPLICATION TO THE U.S. DEPARTMENT OF EDUCATION FOR ALL SARASOTA COUNTY SCHOOLS
Description
COMPETITIVE: Grant funds of $497,877 will strengthen emergency readiness and response plans and processes throughout the district.

That the School Board of Sarasota County approve the Readiness and Emergency Management for Sarasota County, Florida Schools grant application.

12. APPROVAL OF THE CARL D. PERKINS SECONDARY CAREER AND TECHNICAL EDUCATION GRANT APPLICATION TO THE FLORIDA DEPARTMENT OF EDUCATION FOR ALL SECONDARY CTE PROGRAMS
Description

ENTITLEMENT: Grant funds in the amount of $362,471 will provide supplemental funding for the enhancement of secondary Career and Technical Education.

FIELD TRIPS

13. APPROVAL OF BAY HAVEN AND BRENTWOOD ELEMENTARY FIELD TRIP FOR ODYSSEY OF THE MIND WORLD COMPETITION IN AMES, IOWA
Description

Seven Bay Haven students and seven Brentwood students will participate in the Odyssey of the Mind World Competition in Ames, Iowa, May 27 - 31, 2009.



Recommendation
That the field trip for Bay Haven and Brentwood to Ames, Iowa, for the Odyssey of the Mind World Competition, May 27 - 31, 2009 be approved.

EXPULSIONS

14. APPROVAL OF EXPULSION CASE NO. 09-351
Description

The student listed in Expulsion Case No. 09-351 violated School Board Policy 5.321, Possession of Weapons and Other Prohibited Articles.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools for the remainder of the 2008-2009 academic year, the 2009 summer session, and the entire 2009-2010 academic year.



Recommendation

That in accordance with provisions of Sections 1006.07 (1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-351 to expel the student referenced therein from the Sarasota County Schools be approved effective immediately for the remainder of the 2008-2009 academic year, the 2009 summer session, and the entire 2009-2010 academic year.

15. APPROVAL OF EXPULSION ABEYANCE CASE NO. 08-334
Description
School Board Policy 5.34(4) permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in an alternative school.

Recommendation
That Expulsion Case No. 08-334 be held in abeyance per School Board Policy 5.34.

16. APPROVAL OF EXPULSION CASE NO. 09-308
Description

The student listed in Expulsion Case No. 09-308 violated School Board Policy 5.34(1)(d), Extortion/Threat/Intimidation.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4, 2010.

Description

The student listed in Expulsion Case No. 09-298 is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On February 18, 2009, the student listed in Expulsion Case No. 09-298 violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until January 15, 2010.



Recommendation

That in accordance with provisions of Sections 1006.07 (1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-298 to expel the student referenced therein from the Sarasota County Schools be approved effective immediately for the remainder of the 2008-2009 academic year, the 2009 summer session, until January 15 of the 2009-2010 academic year.

Description

The student listed in Expulsion Case No. 08-421 is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On May 16, 2009, the student listed in Expulsion Case No. 08-421 violated School Board Policy 5.324(1)(d), Fighting.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until May 29, 2009.



Recommendation

That in accordance with provisions of Sections 1006.07 (1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 08-421 to expel the student referenced therein from the Sarasota County Schools be approved effective immediately until May 29 of the 2008-2009 academic year.

MATERIALS MANAGEMENT

22. APPROVAL TO AWARD BID #9041 FOR SPORTING AND ATHLETIC GOODS - WAREHOUSE
Description

Bids to provide 'Sporting and Athletic Goods - Warehouse' were received from 14 vendors on April 1, 2009.  The bids of Baden Sports, Inc., Bill Fritz Sports Corporation, Gregg United Sports, Inc., S & S Worldwide, Inc., and Sport Supply Group, Inc., dba BSN Sports were the best low bids meeting the advertised specifications.  Reasons for not selecting the apparent low bid are included with the bid tabulation.  This bid is for a period of one year with the option to renew for two additional one-year periods.  The items will be requisitioned from the Purchasing Warehouse by all schools.  Funds for these purchases are contained in the operating budgets allocated to the individual cost centers.



Recommendation

That the bids of Baden Sports, Inc., Bill Fritz Sports Corporation, Gregg United Sports, Inc., S & S Worldwide, Inc., and Sport Supply Group, Inc., dba BSN Sports to provide 'Sporting and Athletic Goods - Warehouse' in an amount not to exceed $50,000.00, be approved for award and purchase.

23. APPROVAL OF DELETION OF PORTABLES #99-023, #99-319, #99-077, #99-173, #99-118 & #99-027 AT CONSTRUCTION SERVICES / FACILITIES SERVICES DEPARTMENTS
Description
The specified portable(s) recommended for deletion have been inspected by Facilities Services and Construction Services staff and are deemed to be no longer economical to maintain or renovate.  Funds for demolition are available in the capital projects account.

24. APPROVAL OF NON-EXCLUSIVE ACCESS EASEMENT AT SUNCOAST POLYTECHNICAL HIGH SCHOOL BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA AND SARASOTA COUNTY, FLORIDA
Description

This easement will provide an easement for access to the sanitary sewer lift station for operation and maintenance.  This easement has been approved by the School Board attorney.



Recommendation
That the non-exclusive access easement at Suncoast Polytechnical High School between The School Board of Sarasota County, Florida and Sarasota County, Florida be approved as presented.

25. APPROVAL OF AN EXCLUSIVE AND A NON-EXCLUSIVE UTILITY EASEMENT AT SUNCOAST POLYTECHNICAL HIGH SCHOOL BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA AND SARASOTA COUNTY, FLORIDA
Description

These easements will provide for the operation and maintenance of a sanitary sewer lift station and will also provide for the operation and maintenance of the force main and first adjacent manhole to the lift station.  These easements have been approved by the School Board attorney.



Recommendation
That the exclusive and the non-exclusive easement at Suncoast Polytechnical High School between The School Board of Sarasota County, Florida and Sarasota County, Florida be approved as presented.

26. APPROVAL OF THE BILL OF SALE TO SARASOTA COUNTY FOR THE WASTEWATER COLLECTION SYSTEM AT SUNCOAST POLYTECHNICAL HIGH SCHOOL
Description
Sarasota County land development regulations require the ownership of the utility systems be vested with the County.  This item authorizes the transfer of the title of these facilities to Sarasota County.  The School Board attorney has reviewed and approved the Bill of Sale.

Recommendation

That the Bill of Sale to Sarasota County for the Wastewater Collection System at Suncoast Polytechnical High School be approved as presented.

27. APPROVAL OF CONTRACT FOR CONSTRUCTION FOR THE NORTH COUNTY TECHNICAL CENTER PHASE IA/II (SCTI) PROJECT
Description
Under the terms of the 5/15/2007 (Item #47) Board approved "Agreement between Owner and Construction Manager for Pre-Construction & Bidding Services", the Executive Director of Construction Services and two (2) members of the Professional Services Selection (PSSC) have successfully negotiated a contract with Willis A. Smith Construction, Inc. for the North County Technical Center Phase IA/II (SCTI) project.  This contract was negotiated on 4/20/2009.  The 5/15/2007 agreement included pre-construction and bidding services only.  This Contract for Construction includes only the new buildings designed in this phase of the project.  The scope includes site development, building construction and interconnectivity with those buildings that will remain until Phase III of this project.  The Guaranteed Maximum Price (GMP) of this contract is $31,805,856.00.  A separate contract will be negotiated at a later date for the balance of the construction of this project.  This contract is available for review at the Construction Services Department.  The School Board attorney has approved the use of this contract.  Funds for this contract are available in the project budget account.

Recommendation
That the Contract for Construction for the North County Technical Center Phase IA/II (SCTI) project be approved as presented.

28. APPROVAL OF CONTRACT FOR CONSTRUCTION FOR THE TOLEDO BLADE ELEMENTARY SCHOOL - RENOVATION PROJECT
Description

Under the terms of the 10/21/2008 (Item #31) Board approved "Agreement between Owner and Construction Manager for Pre-Construction & Bidding Services", the Executive Director of Construction Services and a member of the Professional Services Selection Committee (PSSC) successfully negotiated a contract with P.J. Hayes, Inc. (dba Tandem Construction) for the Toledo Blade Elementary School - Renovation project.  This contract was negotiated on 4/17/2009.  The 10/21/2008 agreement included pre-construction and bidding services only.  This Contract for Construction includes renovation of the HVAC systems, replacement of ceilings and lighting fixtures, painting and flooring replacement where identified, and the removal of most of the portable classrooms, allowing for re-establishment of play areas and fields, and associated work as identified in the contract documents.  The Guaranteed Maximum Price (GMP) of this contract is $4,997,172.00.  This contract is available for review at the Construction Services Department.  The School Board attorney has approved the use of this contract.  Funds for this contract are available in the project budget account.



Recommendation
That the Contract for Construction for the Toledo Blade Elementary School - Renovation project be approved as presented.

29. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES CHANGE ORDER(S)
Description
The Construction Services Change Order(s) have been summarized on the enclosure for ease of review.  These change order(s) collectively total a reduction of $43,228.54 in contract amounts.

TRANSPORTATION

30. APPROVAL OF REQUEST TO PURCHASE REPLACEMENT VEHICLES FROM THE FLORIDA STATE CONTRACT
Description
Approval to purchase twenty-two (22) vehicles with like vehicles to replace the trucks and vans in the fleet that have exceeded their useful lives and are in excess of eight (8) to ten (10) years old.  The new vehicles will be safer and more cost efficient.

Recommendation
That the purchase of vehicles be purchased from the State Automobile and Light Truck Contract 071-000-09-1, be approved.

New Business
34. RESOLUTION FOR A ONE YEAR MORATORIUM ON EDUCATIONAL SYSTEM IMPACT FEES
Description
Acting upon the request of the School Board of Sarasota County, on April 13, 2004, the Sarasota Board of County Commissioners adopted Ordinance No. 2004-028 establishing county-wide school impact fees.  The County Commission has amended the ordinance twice - on July 28, 2004, Ordinance 2004-085 clarified the affordable housing language, and on July 11, 2007, Ordinance 2007-056 amended the Credits section.  The 2007-08 report (attached) documents the collections, reimbursements and allocations for the past four fiscal years.  At this time the School Board asks that the County Commission institute a county-wide moratorium on the imposition of the Educational System Impact Fee for the period July 1, 2009, through June 30, 2010.  Unless negated by a future Resolution of the School Board, the Educational System Impact Fee Ordinance shall resume July 1, 2010, in its current form.

Recommendation

That the School Board of Sarasota County requests that the Sarasota Board of County Commissioners institute a county-wide moratorium on the collection of the Educational System Impact Fee for all Principal Residential Uses where both (a) an application for the corresponding Building Permit is submitted to or accepted by the County or Municipality during the period July 1, 2009, through June 30, 2010, and (b) the Certificate of Occupancy is issued on or before June 30, 2011.  Unless negated by a future Resolution of the School Board, the Educational System Impact Fee Ordinance shall resume July 1, 2010, in its current form.

35. APPROVAL OF CONTRACT FOR CONSTRUCTION FOR RIVERVIEW HIGH SCHOOL - BUILDING DEMOLITION OF EXISTING CAMPUS PROJECT
Description

Under the terms of the 6/20/2006 (Item #40) Board approved "Agreement between Owner and Construction Manager for Pre-Construction and Bidding Services", the Executive Director of Construction Services and a member of the Professional Services Selection Committee (PSSC) have successfully negotiated a contract with W.G. Mills, Inc. for the Riverview High School - Building Demolition of Existing Campus project.  This contract was negotiated on 2/19/2009.  The 6/20/2006 agreement included pre-construction and bidding services only.  This Contract for Construction includes only the building demolition of the existing campus portion for the referenced project.  The scope shall include demolition of the existing campus and associated work as identified in the contract documents.  The Guaranteed Maximum Price (GMP) of this contract is $594,083.00.  This contract is available for review at the Construction Services Department.  The School Board attorney has approved the use of this contract.  Funds for this contract are available in the project budget account.

That the Contract for Construction for the Riverview High School - Building Demolition of Existing Campus project be approved as presented.
